This Privacy Policy describes how BrainByte, Inc. ("BrainByte," "we," "us," or "our") collects, uses, and shares information about you when you use the Classer API, our website (classer.ai), and related services (collectively, the "Services").
1. Information We Collect
We collect information in two primary categories:
Account & Billing Information: When you create an account, we collect your name, email address, company name, and payment/billing information.
API Payload Data: When you use the Classer API, we process the text, files, or other content you send to us for classification ("Inputs"), as well as the classification results we generate ("Outputs").
Technical & Usage Data: We automatically collect standard technical data when you interact with our Services, including IP addresses, browser types, API request volumes, and error logs.
2. How We Use Your Information
We use your Account & Billing Information and Technical Data to provide, secure, and maintain our Services, process payments, and communicate with you about your account.
How We Treat API Payload Data (AI Training Policy):
We respect the privacy of your proprietary data. BrainByte does not use your API Inputs or Outputs to train, improve, or fine-tune our foundational AI classification models. Your API Payload Data is used exclusively to return the classification request to you and to monitor for technical errors or malicious abuse of our systems.
3. How We Share Your Information
We do not sell your personal information. We only share your information in the following circumstances:
Service Providers: We share data with trusted third-party cloud hosting providers, payment processors, and analytics services that require access to perform services on our behalf. These providers are bound by strict confidentiality agreements.
Legal & Compliance: We may disclose your information if required by law, court order, or government request, or to protect the rights, property, or safety of BrainByte, our users, or the public.
Business Transfers: In the event of a merger, acquisition, or sale of assets, user information may be transferred as a business asset.
4. Data Security and Human Review
We implement industry-standard encryption (in transit and at rest) and strict access controls to protect your data. Learn more on our Security page. No Human Review: BrainByte employees do not read or review your API Inputs or Outputs, except in rare cases where automated systems flag a request for violating our safety and abuse policies, or if you explicitly request our support team to access your data to troubleshoot an issue.
5. Data Retention
Account Data: We retain your account and billing information for as long as your account is active, and for a period afterward as required by law for accounting and tax purposes.
API Payload Data: To protect your privacy, API Inputs and Outputs are retained securely for a maximum of 30 days solely for abuse monitoring and debugging purposes, after which they are permanently deleted from our active systems.
6. Your Privacy Rights
Depending on your location (such as under the GDPR in Europe or the CCPA in California), you may have the right to:
- Access the personal data we hold about you.
- Request correction of inaccurate data.
- Request deletion of your personal data.
- Export your data in a machine-readable format.

BrainByte, Inc. is based in the United States. If you are accessing our Services from outside the U.S., please be aware that your information login, access and payment data will be transferred to and processed in the United States.
